The Aquarium Giveaway: Terms and Conditions for Raffles

Welcome to The Aquarium Giveaway. These terms and conditions govern your participation in any raffle organised by The Aquarium Giveaway. By purchasing a ticket and participating, you agree to comply with them. Please read them carefully before entering any of our raffles.

2. Eligibility
2.1. You must be 18 years or older to participate in any raffle hosted by The Aquarium Giveaway.
2.2. Participation is restricted to residents of the United Kingdom.
2.3. By entering the raffle, you confirm that you meet the age and residency requirements. Proof of identity and age may be required before a prize is awarded.
2.4. Employees of The Aquarium Giveaway Ltd, their immediate families, or anyone professionally connected with the organisation of the raffle are not eligible to participate.
3. How to Enter
3.1. Entries can be purchased through the official The Aquarium Giveaway platform at https://The Aquarium Giveaway.uk/ or other authorised channels.
3.2. Each raffle will specify the entry cost, the number of tickets sold, and the closing date for ticket purchases.
3.3. All ticket purchases are final, and no refunds will be given except in the case of cancellation of the raffle.
3.4. Multiple entries may be permitted, but any limits on the number of tickets that can be purchased per person will be specified for each individual raffle.
3.5. Entries must not be purchased on behalf of individuals under the age of 18.
3.6 Postal Entry Method: Availability and pricing of Competitions is at the discretion on the Promoter and will be specified at the point of sale on the Website. There is no requirement to pay to enter any competition, as each competition has a free entry route available.
To enter any competition via this route the Entrant must firstly create an account via our website, as such postal entries cannot be processed prior to registration. The entrant must then send a hand written postcard / enclosed letter stating which competition they would like to enter, the answer to the questions (question can be found via our website), acceptance of our terms and conditions and the following details: Name, Date of Birth, Home Address, contact number and Email Address (same information used to create a free account on our website) In order for free entries to be processed, Entrants must add their own billing address details to their accounts. All free entries must be posted to: The Aquarium Giveaway Ltd, 25 Glenlossie Drive, Elgin, IV30 6YH and must arrive before the competition closing date. Postage must be paid by the entrant. Postal entries are limited to one entry per postcard / enclosed letter. You will not be notified to confirm your free postal entry has been received until the Competition has closed and the entry list completed. Any postcard / enclosed letter featuring multiple entries will be disqualified as being in breach of these Terms and Conditions.
4. Raffle Draw
4.1. The date and method of the raffle draw will be specified on the raffle page.
4.2. The draw will be conducted fairly, using either a certified random number generator (RNG) or another independently verified method of random selection.
4.3. If a raffle does not meet the required number of entries or for any other reason must be cancelled, participants will receive a full refund.
4.4. The result of the draw is final, and no correspondence regarding the outcome will be entered into.
5. Prizes
5.1. The prize(s) for each raffle will be described on the raffle page.
5.2. Prizes are non-transferable and cannot be exchanged for cash or any other alternative unless otherwise stated.
5.3. Winners will be contacted using the details provided at the time of ticket purchase.
5.4. If a winner cannot be contacted or does not claim their prize within 72 hours of the initial contact, The Aquarium Giveaway reserves the right to offer the prize to an alternative winner or dispose of it as they see fit, in line with applicable regulations.
5.5. The Aquarium Giveaway will bear the cost of delivering the prize to winners within the United Kingdom, unless otherwise stated. International shipping costs, if applicable, must be borne by the winner.
5.6. Once a prize is delivered, The Aquarium Giveaway are not responsible for any maintenance or repairs.
6. Payment and Entry Fees
6.1. All entries must be paid for at the time of purchase through the payment methods specified on the The Aquarium Giveaway platform.
6.2. Entry prices and any associated fees will be clearly stated on the raffle page.
6.3. Any entries that are incomplete, unpaid, or otherwise invalid will not be included in the raffle.
7. Winner Announcement
7.1. Winners will be notified via the contact details provided upon purchase within 24 hours of the draw.
7.2. Winners will be announced on the The Aquarium Giveaway platform and/or social media, but participants may opt-out of such announcements by notifying us at the time of entry.
7.3. By entering the raffle, you agree to allow The Aquarium Giveaway to use your name and location for promotional purposes, and agree to participate in media related activities when the prize is delivered.
8. Responsible Gambling
8.1. The Aquarium Giveaway promotes responsible gambling. If you believe you may have a gambling problem, we encourage you to seek help from organisations such as GamCare (http://www.gamcare.org.uk) or BeGambleAware (www.begambleaware.org).
8.2. We reserve the right to suspend or terminate a participant's involvement in any raffle if there are concerns regarding problem gambling or if they are found to be in violation of these terms.
9. Taxes and Legal Compliance
9.1. Any taxes, duties, or other fees arising from the receipt of a prize are the responsibility of the winner.
9.2. The Aquarium Giveaway will comply with all legal obligations, but winners should seek their own advice regarding the tax implications of their winnings.
10. Liability
10.1. The Aquarium Giveaway, its employees, or agents will not be liable for any loss, damage, or injury arising from participation in the raffle or the acceptance of any prize.
10.2. We are not responsible for entries that are lost, delayed, or misdirected due to technical or other reasons beyond our control.
11. Cancellation or Changes
11.1. The Aquarium Giveaway reserves the right to cancel, modify, or suspend any raffle at its sole discretion if there are reasonable grounds to do so, such as insufficient ticket sales, fraud, or technical issues.
11.2. If a raffle is cancelled, all participants will be entitled to a FULL refund of their entry fees.
12. Data Protection and Privacy
12.1. The Aquarium Giveaway will process personal data in accordance with the Data Protection Act 2018 and the General Data Protection Regulation (GDPR).
12.2. Personal data collected will be used for the purposes of administering the raffle, contacting winners, and complying with legal obligations.
12.3. By entering a raffle, you consent to the collection and processing of your personal data as described in our Privacy Policy.
13. Governing Law
13.1. These terms and conditions, and any disputes arising from participation in The Aquarium Giveaway, shall be governed by and construed in accordance with the laws of England and Wales.
13.2. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
General Information: This raffle is promoted by The Aquarium Giveaway (“the Promoter”). This promotion is in no way sponsored, endorsed, administered by, or associated with Meta, Facebook, Instagram, or any other social media platform. The Aquarium Giveaway is open to legal residents of the UK who are aged 18+. Employees of The Aquarium Giveaway, their immediate family members, and affiliated companies are not eligible. The Promoter reserves the right to verify eligibility.
By entering, participants agree to: Abide by these Terms & Conditions and platform rules. Allow The Aquarium Giveaway to use their name and likeness for promotional purposes. Release The Aquarium Giveaway and social media platforms from any liability related to the raffle.
The Promoter reserves the right to: Disqualify entries that do not comply with these Terms & Conditions. Modify, suspend, or cancel the raffle if necessary. Participant information will only be used for administering the raffle and will not be sold or shared.
14. Livestock
14.1. Delivery Policy
All livestock will be delivered with DX Delivery, a licensed courier specialising in safe transport of Corals and Live Fish. The Aquarium Giveaway Ltd will cover courier costs.
Once a winner is drawn we will contact you to arrange a delivery, available from Tuesday to Friday. It is essential that someone is available to receive the parcel on the arranged day. We cannot take responsibility for delays or missed deliveries.
14.2. Limitations
We can only ship within Mainland UK, certain postcodes within the Scottish Highlands are unfortunately not possible to deliver to due to time restrictions on the couriers behalf. For these post codes we can work to arrange a collection or a hand delivery.
14.3. Dead On Arrival Policy
In the unfortunate and unlikely event livestock arrives DOA it MUST be reported within 1 hour of signing to [email protected] . Pictures must be provided of the coral/livestock in water in the original packaging and also in a container/aquarium. Ideally pictures should have some sort of blue light to show the luminescent of the coral. Without clear photos fitting the requirements a claim may not be processed.
15. Referral Program Terms & Conditions
15.1. Overview
The Aquarium Giveaway Referral Program allows registered users to earn site credit by referring new customers. By participating, you agree to these terms.
15.2. Eligibility & Qualifying Referrals
To earn a £5 Referral Credit, the following conditions must be met:
- The Referrer: Must have an active, registered account on our website.
- The Friend: Must be a new customer (cannot have an existing account or have placed a previous order).
- The Purchase: The referred friend must place a successful order with a minimum spend of £10 (excluding shipping costs).
15.3. Reward Structure
- Referrer Reward: £5 site credit for every successful referral.
- Friend Reward: £5 site credit upon completion of their first qualifying purchase.
- No Limits: There is currently no cap on the number of friends you can refer.
15.4. Approval & Payout Process
To maintain the integrity of our giveaways, all referrals are subject to manual review:
- Review Period: Referrals are typically reviewed by the team and are typically credited within 3-5days of eligible purchase.
- Credit Issuance: Credits will be added to your account balance only after the referral has been formally approved.
- Non-Transferable: Site credits have no cash value, cannot be withdrawn as bank transfers, and are non-transferable between accounts.
15.5. Prohibited Use (The "Anti-Gaming" Rules)
We reserve the right to disqualify any referral and void credits if we detect "gaming" of the system, including but not limited to:
- Self-Referral: Creating multiple accounts to refer yourself.
- Duplicate Identities: Referrals involving the same household, IP address, or payment method as the Referrer.
- Public Spamming: Posting referral links on coupon sites, review platforms, or "spamming" strangers. This program is intended for personal sharing with friends and family.
15.6. Termination & Changes
The Aquarium Giveaway Ltd reserves the right to:
- Modify or terminate the Referral Program at any time without prior notice.
- Change the reward value or minimum spend requirements.
- Suspend accounts found to be in violation of these terms.
